Kendall Jenner Sues Skincare Company

Model Kendall Jenner is reportedly suing an acne skincare company for using her image in their promotional campaigns without her permission. Apparently, they not only used?her name and likeness without permission, but they also?claimed that Jenner?endorses the product. The advertisement for Cutera Laser Genesis bears a quote from Jenner that acne “completely ruined” her self-esteem – something that she said last year – alongside the claim that visits to a Laser Genesis dermatologist have left her with “nearly flawless skin”.

According to TMZ, legal documents listed the range of publications that the 20-year-old model has appeared in alongside the claim that she would usually charge an “eight-figure sum” for such an endorsement,’so this suggests that she is suing the company for at least?$10 million.

Jenner insisted’she never did a deal to promote the company, and claims she would charge well into the eight figures for a similar endorsement. ?In addition to being the face of Estee Lauder, the lawsuit points out Jenner?has been on the cover of numerous fashion magazines around the world, and would typically earn a hefty sum?to endorse?any product.?The 20-year-old is seeking that the company hand over its profits, which would apparently exceed $10 million.

“The right to associate Kendall Jenner’s name and likeness in connection with a product or service belongs solely to Kendall Jenner and is protected by Federal and State law,” said lawyer?Todd Wilson. “This lawsuit by Ms. Jenner against Cutera, Inc., for the unauthorised use of Ms. Jenner’s name and likeness to promote its product should serve notice that she?will vigorously defend her rights under the law.”

Jenner is the latest public figure to take legal action against a company for unauthorised image usage. Actress Sofia?Vergara filed a similar $15 million lawsuit against US?company Venus Concept, saying that the brand had repeatedly used her image in various promotional materials without her say-so over the last number of months.

Cashing in on any person’s name without their permission crosses moral and legal boundaries, so we’re at a loss as?to why any company tries to chance their arm in this regard. The publicity surely won’t be worth anything if they lose?their reputability and business to bankruptcy.
